Asset Forfeiture Attorney In Chicago

If a person was accused and acquitted of a crime, and their property was used as evidence, shouldn’t they get their property back? Most people would think so, but the reality of the situation is very, very different. In fact, if money is seized as evidence in a crime, there’s often little chance that it will ultimately be returned.

At Wolf Criminal Law, our founding attorney, Bill Wolf, has a long career of helping clients facing some of the steepest challenges to their rights. One of the most frustrating is the concept of asset forfeiture, which transfers untold amounts of money directly from citizens accused of a crime to police. Police utilize captured assets, meaning that securing their return will be an uphill battle, but it is one that we will be happy to take on for you.

An Overview Of Asset Forfeiture

In Chicago and all over Illinois, assets deemed to be evidence in a crime are seized by law enforcement to build a case against the assets owners. Typically these types of seizures are of property such as:

  • Weapons
  • Cash
  • Vehicles
  • Jewelry
  • Business assets

Any of these can be seized as evidence, however these assets must be seen as evidence of a crime or at least part of the criminal enterprise. These assets go into police custody and are held as evidence. However, even an acquittal does not automatically return any asset seized to you.

Asset Forfeiture Is Your Property On Trial

To recover assets seized as part of an asset forfeiture action, you have to prove that the property was not connected to criminal activity. This puts the burden of proof on you, and you have to make a compelling case.

Asset forfeiture is a key tool that police use in collecting evidence against drug dealers, but police tend to cast a much wider web than necessary. Huge amounts of money and property stays in police coffers every year because of how challenging it is to win these cases.
