Illinois Criminal Defense FAQ
If you are facing a criminal charge or believe you are under investigation, we offer a free initial consultation to get your immediate questions answered by an experience criminal defense attorney. Mr. Wolf has been successfully defending accused individuals for more than 30 years. Below, we have also answered some of the more common questions our clients have.
What should I do if the police ask to search my home or car?
In the absence of a search warrant, you can decline to have police or investigators search you or your property. Politely decline, tell them you want your lawyer present, and call Wolf Criminal Law. Do not say anything more to police or investigators. Exercise your right to remain silent.
If law enforcement already has a search warrant, call us right away. Do not try to prevent investigators from conducting a search if they already have a warrant. We can investigate whether the search was conducted properly and within the scope of the issued warrant. If mistakes were made, it may be possible to have the seized evidence kept out of court.
I already talked to the police. What should I do now?
Don’t say anything else to the police. Contact us immediately. When you talk to police without us there to assist you, the police can ask you all kinds of leading, incriminating questions that, on the surface, seem fine. However, their goal is to get you to talk, so they can use your words against you.
Our team can help you understand which questions to answer and which questions never to answer. We can advise you of your rights and help you from making your case a lot worse.
The prosecutor has a lot of evidence. Should I just plead guilty?
Do not plead guilty before contacting Wolf Criminal Law. Even if the prosecution claims to have a lot of evidence against you, any mistakes on the part of law enforcement or violations of your rights could be used in your favor. Let our skilled criminal defense attorney investigate your case and develop the best possible strategy for protecting your rights and freedom. Our law firm has a long history of getting serious charges reduced or dismissed. We prepare each case as if it will go to trial because that is the best way to strengthen each client’s position, even if the case is ultimately resolved in the pre-trial phase.
What is the difference between a felony and a misdemeanor?
While both felonies and misdemeanors are crimes that carry quite serious consequences, felonies are considered more serious. In fact, the technical difference between a felony and a misdemeanor is centered on jail time. If the potential penalty is more than one year, then it is a felony.
That said, even though a felony carries a longer jail sentence and probably high fines, misdemeanors can also carry just as many frustrating long term consequences.
What penalties could I face if convicted?
If you are convicted of a crime, you likely will face penalties such as fines and jail time. However, there can be other consequences that more closely relate to the criminal act. For example, a drunk driving charge may lead to loss of driving privileges. Prescription drug fraud may lead to a loss of your professional licensing.
Every criminal charge comes with penalties that the state believes suit the crime.
Why should I hire a private criminal defense lawyer instead of a public defender?
Public defenders do a great job under the circumstances they face. They have to manage a massive caseload and work for every person that cannot afford a private defense. However, public defender offices are underfunded and understaffed, and they simply may not have the resources to put on the best fight.
On the other hand, private defense attorneys are not restricted to the resources allocated by the state. We have developed our reputation and ability by helping our clients individually. We have the time to focus on you, and the resources and experience to pursue your case with the zeal and aggression you deserve.
