Seventh Circuit Holds That Indiana Class B Burglary Is an Acca Enhancement Qualifier

In this case, the Defendant challenged an Indiana Class B burglary conviction claiming it did not qualify as a burglary for purposes of the Armed Career Criminal Act. The Seventh Circuit held otherwise, noting that this issue was dealt with in United States v. Perry and ruled that the district court properly applied ACCA’s enhancement to the defendant’s sentence.

The case is United States v. Foster.
